Hum apne intellectual property rights ka jitna aitraam karte hain, utna hi doosron ke huqooq ka bhi khayal rakhte hain. Digital Millennium Copyright Act (DMCA) – Title 17, United States Code, Section 512(c) ke mutabiq, agar kisi copyright malik ko lagta hai ke uska kaam baghair ijazat istemal ho raha hai, to woh humein official takedown notice bhej sakta hai.

Copyright Infringement Claim Karne ka Tareeqa

Agar aap ek bona fide infringement claim bhejna chahte hain, to neeche di gayi maloomat ke mutabiq apna complete notice bhejna zaroori hai:

  1. Copyright malik (ya uske authorized representative) ki physical ya electronic signature.

  2. Us kaam ki wazeh pehchan jo copyright ke tehat protected hai.

  3. Infringing material ki tafseel aur exact URL taake hum usay locate aur remove kar saken.

  4. Complainant ka naam, address, email, phone number (aur agar ho to fax number).

  5. Ek statement ke complainant ki good faith belief hai ke material baghair ijazat istemal ho raha hai.

  6. Ek statement ke di gayi maloomat dursat hai, aur complainant ko copyright malik ki taraf se amal karne ka ikhtiyar hasil hai (under penalty of perjury).

📌 Note: Title 17 USC §512(f) ke mutabiq, agar koi shakhs jhoot ya ghalat taur par infringement ka claim karta hai, to us par legal action, penalty, kharche aur advocate fees lag sakti hai.

Counter Notification – Content Wapas Restore Karwana

Agar aapko DMCA notice mila hai jisme aapka content copyright infringement ki wajah se hata diya gaya hai, to aap counter notice bhej kar apna content restore karwa sakte hain.

Counter notice mein yeh maloomat shamil honi chahiye:

  • Aapki physical ya electronic signature.

  • Jo material remove hua uski tafseel aur uska original location/URL.

  • Aap ka bayan (under penalty of perjury) ke removal ghalti ya galat pehchan ki wajah se hua.

  • Aapka naam, address, phone number, aur bayan ke aap U.S. federal court ke jurisdiction ko tasleem karte hain (agar aap U.S. ke bahar hain to service provider ke district court ka jurisdiction).

  • Bayan ke aap original complainant se legal process receive karne ke liye tayar hain.

Counter notice bhi Contact Page ke zariye bheji jaye.
Email ka istemal strongly recommended hai.

Repeat Infringer Policy

Hum copyright violations ko bohot sanjeedgi se lete hain. DMCA ke mutabiq, hum ek internal record maintain karte hain jisme repeat infringers ko note kiya jata hai.
Jo users baar-baar violation karte hain, unka account permanently terminate kiya ja sakta hai.

Tabdeeliyan (Modifications)

Hum kisi bhi waqt, kisi bhi wajah se is DMCA Policy mein tabdeeli ka haqq rakhtay hain.
